<p class="MsoNormal">HSE and the Environmental Agency have pulled up TAV Engineering, Hertfordshire Oil Storage Ltd (HOSL) and Motherwell Control Systems 2003 Ltd for their alleged role in Buncefield oil depot tragedy.</p>

<p class="MsoNormal">It has now become known that the workers at Buncefield Oil Depot site were not adequately trained and were under lot of pressure due to high volume of work. The blast which took place in December 2005, measuring 2.4 on the Richter Scale, caused immense damage to commercial and residential buildings nearby and threw up a lot of debris which polluted the environment. Overall, 40 casualties were reported and the explosion was heard 125 miles away.</p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">Telegraph reports confirmed that the pressure exerted on supervisors was enormous. They were expected to fill the tanks to the maximum and keep moving the volumes with very less or no adequate support provided for operations. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">The investigation found that there was no process defined for the operations of how to fill the tanks, how to empty, and the safety rules to be obeyed. The entire operation lacked <a href="http://www.businesslink.gov.uk/bdotg/action/detail?r.s=sl&amp;r.lc=en&amp;type=RESOURCES&amp;itemId=1083937046">safety audit and practices </a>apart from employee safety, felt the Prosecuting lawyer, Andrew Langdon QC.</p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">He also said that one could see that the volumes passing through this particular depot had increased tremendously more than four times over the last ten years. Though a trained supervisor would not fill the tanks to such high levels, the sheer pressure prompted them to fill the tanks to the brink.</p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">The judgement in this case can be expected after June once the trials are completed. Motherwell Control Systems 2003 Ltd, being currently under voluntary liquidation, is expected to co-operate with the case. British Pipeline Agency Ltd has accepted its responsibility on two charges connected with the explosion. Total UK has also admitted to break of safety and health on three counts.</p>

At least 20 thousand more cases have come up before the employment tribunals every year. The changes in law are expected to result in more confusion. Many blame EU laws for the chaos, as they bring in change without stability. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">However, Mr Wilder states that there is nothing wrong with the EU laws. When they are converted into an Act in the <st1:country-region w:st="on"><st1:place w:st="on">UK</st1:place></st1:country-region>, the clauses often tend to get ambiguous. As a result, people who are not sure of the law bring in more and more cases. He also adds that the workers are more aware of their rights and thus are ready to file a suit to address their grievances. They can afford to do so because many lawyers these days charge their fee only after winning the case. According to him, the numbers may go even higher in the near future.</p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">The firm also did a study that suggested that every <a href="http://www.employmenttribunals.gov.uk/">employment tribunal</a> costs approximately &#163;7,000. This will mean that the companies will have to spend &#163;2.6 billion in the coming three years on legal advice and on payment of claims. The firm&#8217;s Employment Tribunal Trends Index seems to say that there will be approximately 370,000 more cases before the employment tribunal in the years 2010-2013 as compared to the years 2007-2010. This will cause the average cost of an employment dispute to go up by 46%.</p>
<p class="MsoNormal"><span style=""> </span></p>
<p class="MsoNormal">James Wilder also opines that the <a href="http://business.timesonline.co.uk/tol/business/law/article7096580.ece">Equality Bill</a> may add to the number of employment disputes if it is enacted into a law by the Parliament. The clauses are likely to add to the confusion created by legal provisions and burden the tribunals to a higher degree. This may increase the cost of employment disputes by more than what has been stated above, making it even more expensive for the companies.</p>
